Use of the site www.sitroom.io and associated sub-domains implies full and complete acceptance of the general conditions of use described below (hereinafter the "GTU"). These conditions of use may be modified or supplemented at any time.

This site is normally accessible to users at any time. An interruption due to technical maintenance may however be decided at any time.

 

1. General provisions

 

The websitewww.sitroom.io(including the subdomainwww.app.sitroom.io) (hereinafter the "Site") are the property of the company Sitroom and provide access to collaborative mapping services dedicated to information management for the benefit of the teams defined herein (hereinafter: the "Services ").

 

These Terms govern the use of the Site and from your account and provide information on its operation.

 

The Application thus aims to virtually bring people together through a collaborative group around a geographical map, and to share information in real time, georeferenced or not. She permits :

•   To create georeferenced databases in a collaborative way based on the Google Maps mapping server, to filter and list them

• To attach objects connected to the collaborative group via a service using the Twilio API in order to have automated data feedback (position, speed, direction)

• To exchange messages and attachments in real time via a chat integrated into the collaborative group

2. Privacy Policy

 

The Site and Application are also subject to our Privacy Policy, which describes how your personal information is collected, used, shared and stored. These are described in thegeneral conditions of services.

 

 

3. Opposability of the T&Cs

 

When activating your account, you acknowledge that by clicking on "Register", then by accessing or using your account from the Site and/or the Application, you accept all of these T&Cs and that you understood the meaning and scope.

We invite you to read the TOS carefully before starting to use the Site and/or the Application and recommend that you keep a printed version.

Any subsequent connection to your account on the Site and/or the Application is subject to compliance with the T&Cs which are accessible by a direct link on the Site and/or the Application.

 

We may modify our T&Cs and our Privacy Policy at any time. In case of modifications, we will inform you, so that you can take note of these modifications.

If you object to any of these changes, you can refuse the new T&Cs and the Privacy Policy. In the event of refusal of the T&Cs and/or the Privacy Policy, your account will be suspended and, if necessary, deleted upon simple request.

Your data will be erased or anonymized a maximum of 3 months after your refusal. If you continue to use the Site and/or the Application, this means that you accept the modifications.

 

 

4. Creating an account

 

4.1. Terms

 

Registration is done via the app.sitroom.io subdomain via the login icon.

The opening of the Client Account is carried out as follows:

on the registration page of the application, the Customer completes the form provided for this purpose. The Customer must provide all the information marked as mandatory  namely: First name, Last name, valid email address and password. Any incomplete registration cannot be validated.

 

By validating the completed form, the user accepts all of the general conditions of use and sale of SitRoom.

 

The type of account will be determined according to the subscription taken by the Customer:

• User account (by default): free without contractual formalities

• Premium, Pro and Creator accounts: paying and requiring a contract with SitRoom.

 

It is possible to access the application without creating an account under two conditions:

• Invitation to a situation by an already registered user

• Use for testing and demonstration.

 

4.2. Form (information)

 

The Customer must provide all the information marked as mandatory, namely:

• First name,

• Name,

• valid email address

• password.

 

You guarantee that all the information provided in the form is accurate, up to date and sincere and is not vitiated by any misleading character.

 

As such, you guarantee not to provide information that could infringe the rights of third parties and/or morality.

 

Sitroom reserves the right to verify the compliance of the information provided to allow access to the Services.

 

In the event that you provide false, inaccurate, erroneous, outdated, incomplete, misleading or misleading information, Sitroom reserves the right to refuse any access to the Site and/or the Application and/or the Services.

 

 

5. Access to the account from the Site or the Application

 

5.1. Login requirements

 

To use the Site and/or the Application under normal conditions, you must have:

• A terminal for connecting to the internet

• a sufficient Internet connection

• a browser compatible with the display of the application

 

5.2. Username and password

 

Your account is protected by identification elements, an identifier (email address) and a password.

If you forget the password, you will need to enter the email address of your account. You will receive an email with a link allowing you to reset your password.

In the event of suspicion of fraudulent use, SitRoom reserves the right to carry out verifications of use.

 

5.3. Subsequent account logins – Cookies

 

Your account data is stored via cookies on your own browser, which makes it possible to make the connection persistent (configurable) and to recognize you as an existing user. You can thus return more easily to your account without having to identify yourself again each time you open the Application. However, you can choose to disconnect via your account at any time.

 

5.4. Suspension and closure of the account

 

To suspend or close your account, you can contact the support team on the address[email protected]. The account will be deleted within three weeks.

Upon suspension or termination, you lose the right to access or use the Site and the Application.

Your data will be deleted or anonymized, in accordance with our Privacy Policy. Anonymized data may be kept for statistical reasons.

We do not guarantee that we will store or continue to display the information you have provided once your account is closed. You agree that Sitroom has no obligation to store, maintain, or provide you with a copy of the information submitted by you, except to the extent required by applicable law and as described in our Privacy Policy.

 

 

6. Account functionality

 

Sitroom provides the Customer with a software solution (hereinafter: the "Solution"), intended to facilitate the preparation, organization and monitoring of the activity of the members of a team or several teams of Users by creating collaborative cartographic situations (hereinafter: the “Situations”).

The use of the mapping service published by Google Maps implies acceptance of the general conditions of use of the Google Maps service interfaced in API with the SitRoom solution. This acceptance is effective upon registration on SitRoom.

 

6.1 Creating a Situation

 

The Solution allows advanced Administrators and users to create collaborative groups around a map by inviting other users with a Client account.

They then become the administrators of this "situation", giving them various rights described in 6.2.

 

6.2 Managing a situation

 

Administrators are the only ones authorized to manage a situation: modify the title and central location, add or remove users, lock the situation, archive the situation.

 

6.3 Participation in a situation

 

All parties can interact on the situation either via chat or by creating, modifying or deleting data sheets entered on the map. It is also possible for them to consult all the data via the table view and to use the filter and search functionalities of the georeferenced data entered on the situation map.

 

6.4 Tracking Service

 

It is possible to interface connected objects on the platform to transmit a geographical position (hereinafter called Trackers). This is done through a tracker made available by SitRoom and including a subscription either provided by the Client or contracted with SitRoom.

The use of this service implies the acceptance of the general conditions of use of the Twilio SMS server service interfaced in API with the SitRoom solution. This acceptance is effective upon registration on SitRoom.

Use of the communication service implies acceptance of Matooma's general conditions of use. This acceptance is effective upon registration on SitRoom.

The Customer must comply with the legislation concerning the use of means of tracing. Under no circumstances can SitRoom be responsible for the terms of implementation of this service by this Customer.

 

 

 

7. Support

 

In the event of difficulty encountered on the Site or the Application, for any question related to the use of the Services, Sitroom offers the Customer technical support consisting of assistance and advice.

Technical support can be reached via [email protected].

Depending on the need identified, Sitroom will estimate the deadline for its response and the nature of the latter and will keep the Client informed.

Sitroom's intervention windows are between 9 a.m. and 7 p.m. during working days. A working day means an uninterrupted period of ten (10) hours, Monday to Friday, between 9:00 a.m. and 7:00 p.m., Paris time, France.

 

8. Ownership of Information

 

You remain the owner of the content and information that you provide on the Site or the Application.

 

 

9. Restrictions

 

Sitroom reserves the right to restrict, suspend or terminate your account if you do not comply with these T&Cs or the law or if your use of the application is abusive.

 

 

10. Intellectual Property

The general structure as well as the software, texts, images animated or not, its know-how and all the elements composing the site are the exclusive property of Sitroom.

The logos and brands mentioned on www.sitroom.com are the exclusive property of Sitroom.

Any representation, reproduction, and/or exploitation, whether partial or total, of the aforementioned brands is (are) prohibited, except with the prior written consent of their holders.

 

Any total or partial representation of the blog associated with www.sitroom.io by any person whatsoever, without express authorization is prohibited and would constitute an infringement punishable by articles L. 335-2 and following of the Intellectual Property Code.

 

 

11. Warranties

 

11.1 General Warranties

 

By accessing the Site or the Application, you guarantee:

 

• Access the Services in good faith, in accordance with the provisions of these T&Cs;

• Not directly or indirectly market the Services and/or access to the Services;

• Do not allow third parties to use your account;

• Not to use the Site, Application or Services for purposes other than those for which they were designed by Sitroom;

• Not to reuse all or part of the Services it contains, in particular for commercial or personal purposes, in a form not authorized by Sitroom;

• Copy or divert any element of the Site or the Application;

• Treat information and data about other users confidentially and not use them for purposes other than those of the Services;

• Respect the rights of other users and not share, copy or transmit to a third party their information entered on the Site or the Application.

 

You are solely responsible for choosing to use the Services and for ensuring that they meet your needs, for securing your computer system and for backing up your data.

 

You are personally responsible for the use of the Services and the information provided, in particular when creating your account and using the Services.

 

The use of SitRoom or its services in conflict zones as defined in International Humanitarian Law is the sole responsibility of its users.

 

You guarantee to indemnify Sitroom against any damage suffered and against any action for liability that may be brought against it on the basis of the violation of the T&Cs.

 

11.2 Specific guarantees (chat)

 

By using the chat integrated into the Services, you guarantee:

 

• Use the chat in good faith, respecting the provisions of these T&Cs;

• Not to impersonate, threaten, intimidate, insult, defame, harass other users, persons or entities;

• Not send any obscene, indecent, vulgar, malicious, violent, hateful, discriminatory, xenophobic, racist, pedophile, pornographic, sexually charged or otherwise unlawful message or content;

• Do not use the chat for political, ideological or proselytizing purposes;

• Do not broadcast advertising;

• Do not disseminate personal and nominative information about a person without their consent.

 

11.3 Measures in case of breach

 

In the event of a breach on your part of any of the provisions of the T&Cs or more generally, a violation of the laws and regulations in force, Sitroom reserves the right to take any appropriate measure and in particular:

 

• Interrupt or suspend, at any time and without prior notice, temporarily or permanently, your access to the Site, the Application or the Services;

• Suspend or terminate your account, at any time and without prior notice, temporarily or permanently;

• Notify any competent authority;

• Engage in any legal proceedings.

 

The interruption or suspension of your access to the Site, the Application or the Services, as well as the suspension or termination of your account:

 

• Shall intervene without prejudice to any damages that Sitroom may claim in compensation for the damage suffered as a result of your breaches;

• Under no circumstances will you be entitled to the allocation of compensation of any kind whatsoever.

 

You acknowledge that in the event of a breach on your part, you remain liable for the subscription until the end of the subscribed period and in any event, for the payment of the Services.

 

 

12. Disclaimer and Limitation of Liability

 

12.1. No Warranty

 

Sitroom undertakes to make its best efforts to ensure the operation of the Site and the Application under the best conditions.

 

Sitroom does not give any guarantee concerning the operation of the Site and the Application, in particular that the Services will not be interrupted. The occurrence of technical difficulties, maintenance, tests or necessary updates may, for example, occasionally cause temporary interruptions. The Site and the Application are provided on an "as is" basis and accessible according to availability.

 

Sitroom disclaims all warranties, express or implied, relating in particular to the satisfactory quality, the compatibility of the Site or the Application for a specific use, the accuracy of the data and the non-violation of the rights of third parties and the rules use of the application by its users.

 

12.2. Disclaimer

 

Sitroom cannot be held responsible for the possible loss of information accessible on your account. It is your responsibility to save a copy.

 

Sitroom cannot be held responsible for any direct, indirect, incidental, special, incidental, consequential or punitive damages, etc., as well as for any loss of profits or income that you may suffer, directly or indirectly related to:

 

• Access to or use of the Site, Application or Services;

• The inability to access or use the Site, Application or Services;

• Any conduct or content submitted, published or posted on the Site or Application.

 

In any case, Sitroom cannot be held liable in the event of non-compliant use of the Site or the Application by its users. You are solely responsible for all content and information that you provide and publish.

 

You acknowledge that your sole remedy for any difficulty or dissatisfaction with the Services is to uninstall the Application or delete your account.

 

Furthermore, the use of the information contained on the blog is the sole responsibility of the user. Sitroom cannot under any circumstances, and for any reason whatsoever, be held responsible, regardless of the consequences.

 

13. Applicable law and competent jurisdiction

 

These T&Cs are subject to French law.

In the event of a dispute and in the absence of prior amicable settlement, the courts of Versailles shall have sole jurisdiction.
